Vaping in Germany is governed by the Tobacco Products Act (Tabakerzeugnisgesetz / TabakerzG), the Tobacco Duty Modernization Act (Tabaksteuermodernisierungsgesetz / TabStMoG), the Electrical and Electronic Equipment Act (ElektroG), and the European Union Tobacco Products Directive (TPD). Following these rules is essential to avoid fines or legal consequences.

Legal Status and Age Restrictions

  • Age Limit: Vaping is strictly legal only for individuals 18 and older. ID verification is mandatory for all vaping purchases, including nicotine-free e-liquids and hardware, as enforced under the German Youth Protection Act (Jugendschutzgesetz). Bring government-issued identification when visiting our shop.

Where You Can and Cannot Vape

  • Enclosed Public Spaces: Vaping is prohibited in enclosed areas where smoking is banned, including public transportation (trains, buses, trams), restaurants, bars, and indoor workplaces. Violations can trigger administrative fines up to €8,000.
  • State-Specific Regulations: In federal states like Hessen, vaping is restricted anywhere conventional smoking is banned, including select designated outdoor pedestrian areas.
  • Near Children: Vaping is prohibited in areas frequented by children, including school grounds, playgrounds, daycare facilities, and sports grounds.
  • Airports and Train Stations: Vaping is permitted exclusively in marked designated smoking/vaping areas (indicated by yellow line boundaries or enclosed cabins).

  • The Stamp (Steuerzeichen): Every legal e-liquid bottle or pre-filled pod sold in Germany must feature an unbroken official German physical tax stamp over the cap or closure. A missing or broken stamp indicates an untaxed, illegal, or counterfeit product.
  • Hardware: Vape hardware (mods, tanks, batteries) is subject to standard 19% Value Added Tax (Mehrwertsteuer / MwSt) but does not require a tobacco tax stamp.

Disposable Vapes: Take-Back Regulations & EU Rules

  • Take-Back Obligation: Under the Electrical and Electronic Equipment Act (ElektroG), all retailers selling disposable e-cigarettes are required to take back used single-use vapes free of charge, regardless of whether a new purchase is made. Disposables contain integrated lithium batteries and must never be disposed of in standard household trash. Drop off used devices at dedicated collection bins in retail shops or municipal recycling sites.
  • Phase-Out Timeline: Under EU Battery Regulation 2023/1542, single-use vapes with non-replaceable, non-rechargeable batteries are being phased out in favor of rechargeable pod systems and eco-compliant hardware.

Illegal Substances & Military Restrictions

As U.S. service members, you are bound by Department of Defense (DoD) directives, Army Regulation 600-85, and the Uniform Code of Military Justice (UCMJ). The following restrictions apply regardless of local civilian legal status in Germany:

  • Blue Lotus (Nymphaea caerulea): Contains psychoactive alkaloids (apomorphine, nuciferine). While accessible in parts of Europe for civilian purchase, Blue Lotus is listed on the DoD Prohibited Dietary Supplement List (OPSS) and is prohibited for military personnel worldwide. Unregulated Blue Lotus products frequently contain undeclared synthetic cannabinoids detectable on military drug tests.
  • Synthetic Cannabinoids: Compounds marketed under terms like "Spice," "K2," or synthetic THC analogs are banned under military law and prohibited in Germany under the New Psychoactive Substances Act (Neue-psychoaktive-Stoffe-Gesetz / NpSG).
  • THC (Tetrahydrocannabinol): Although Germany permits limited adult civilian possession and cultivation under the Cannabis Act (Konsumcannabisgesetz / KCanG), military personnel are prohibited from possessing, consuming, or distributing any form of THC.
  • HHC (Hexahydrocannabinol) & Semi-Synthetic Cannabinoids: The manufacture, sale, transfer, and trade of HHC and similar semi-synthetic cannabinoids are illegal in Germany under the NpSG. HHC is prohibited for service members under DoD regulations.
  • Delta-8 THC: Classified as a controlled substance in Germany and prohibited under DoD directives.
  • CBD (Cannabidiol): DoD regulations prohibit service members from using commercially available CBD products due to the risk of trace THC contamination and lack of FDA approval (excluding FDA-approved prescription medications like Epidiolex).

  • German Civil/Criminal Penalties: Violations of German drug laws (KCanG, BtMG, NpSG) can lead to civil fines up to €30,000 or criminal prosecution, confiscation, and imprisonment depending on the offense and quantity.
  • Military Penalties: Violations of DoD drug policies or UCMJ Article 112a result in administrative actions, non-judicial punishment (Article 15), court-martial proceedings, loss of rank, forfeiture of pay, or discharge under less than honorable conditions.
